Affiliate Program Terms and Conditions

Last Updated: August 15, 2024

Welcome to the MyKaraoke Video Affiliate Program! By signing up to be an affiliate in the MyKaraoke Video Affiliate Program ("Program"), you agree to be bound by the following terms and conditions ("Terms"). Please read the entire agreement carefully before registering and promoting MyKaraoke Video.

1. Eligibility
Anyone can join the MyKaraoke Video Affiliate Program. There are no specific eligibility requirements regarding age, location, or the type of website. By participating in the Program, you agree to comply with these Terms and all applicable laws.

2. Commission Structure
   - Affiliates will receive a 25% commission on all payments made by referred customers, including renewals, upgrades, and recurring subscription payments.
   - The commission is calculated based on the total payment amount. For example, if the referred customer spends $10, the affiliate will earn $2.50.
   - The commission rate is fixed at 25%, and there are no performance-based tiers.

3. Payout Terms
   - Payouts will be made on a Net-30 basis, meaning payments will be issued 30 days after the end of the month in which the commission was earned.
   - All payments are made via PayPal. Affiliates must have an active PayPal account to receive their commissions.
   - The minimum payout is $10. Affiliates will get paid on the next payout date after they reach, at least, $10 in commissions.

4. Cookie Duration
   - The affiliate tracking cookies have a 60-day lifespan. If a referred user makes a purchase within 60 days of clicking the affiliate link, the commission will be attributed to the affiliate.
   - No specific rules apply regarding cookie overwriting or last-click attribution.

5. Promotional Guidelines
   - Affiliates are free to promote MyKaraoke Video using any legitimate marketing methods they choose. There are no specific restrictions on keywords, ads, or other promotional activities, provided they comply with applicable laws and ethical standards.
   - Affiliates are permitted to use MyKaraoke Video branding, logos, and other marketing materials provided by MyKaraoke Video. However, affiliates are expected to represent MyKaraoke Video accurately and avoid misleading claims.

6. Affiliate Responsibilities
   - Affiliates are responsible for keeping their account information up to date and ensuring that their marketing materials reflect the current MyKaraoke Video offerings.
   - Affiliates agree to comply with all applicable laws and refrain from engaging in fraudulent activities, including generating fake referrals or payments.

7. Termination
   - MyKaraoke Video reserves the right to terminate any affiliate account at its sole discretion if fraudulent referrals, disputed payments, or other similar causes are detected.
   - In the event of termination, any commissions earned prior to termination will be paid to the affiliate unless the termination was due to fraud.
   - Affiliates may also terminate their participation in the Program at any time.

8. Governing Law
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States.

9. Limitation of Liability
MyKaraoke Video shall not be liable for any indirect, incidental, consequential, or special damages (including but not limited to loss of revenue, profits, or data) arising out of or in connection with the Affiliate Program or these Terms. The affiliate agrees to indemnify and hold harmless MyKaraoke Video, its officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of the affiliate's participation in the Program.

10. Modification of Terms
MyKaraoke Video reserves the right to modify these Terms at any time. Any changes will be notified to affiliates via email and published on the following page: https://www.mykaraoke.video/affiliates/tos. Continued participation in the Program after such modifications shall constitute the affiliate's agreement to the new Terms.
